San Diego State University Criminal Justice Practice Right to Counsel Paper

This assignment requires each student to (i) submit a draft of their paper, (ii) provide constructive feedback on another student’s paper, then (iii) submit a final paper.

Description of Assignment:

Identification and Description: Identify and describe a current criminal justice practice relating to one of the following: interrogations, confessions, identifications, exclusionary rule, entrapment, prosecutorial discretion, bail, right to counsel, courtroom process, jury selection, sentencing, and counterterrorism.

Constitutional Analysis: Explain how the Court would likely rule on a constitutional challenge to the practice. Your constitutional analysis should (i) identify relevant constitutional provisions and case law, and (ii) explain how the case law relates to the facts (i.e., the criminal justice practice). Strong analyses will include cases not covered in class.

Personal Thoughts: Express your opinion about the Court’s jurisprudence (i.e., the body of law created when the Court decides cases). Argue for or against how the Court has handled the issue.
